Registering for a personal account and subscribing to Churchill emails

You must be over 18 to register for a personal account, subscribe to Churchill emails and/or place an order with Churchill. You must comply with applicable laws and regulations of the United Kingdom. We will not be liable or responsible if you break any such law. By placing an order with us you are confirming that you are of the appropriate legal age to purchase the products. If we discover that you are not legally entitled to order products, we will not be obliged to complete the order.

To order products using the Website, we ask you to register for a personal account. Any personal data that you provide us with during the registration process will be stored in our database and may not need to be re-entered with each new order. We will only use the stored data in accordance with our privacy policy which can be viewed here.
 
The Order Processing & Confirmation
You can place an order if:  
  • you are at least 18 years of age;
  • you are the owner or authorised holder of a valid debit/credit card, PayPal, Klarna, Apple Pay or Google Pay  account to pay for your purchases; and
  • you agree to provide your real name and correct and complete address, phone number, email address, payment details and other required information.

All products on this website are subject to availability. 

A contract between us and you will be created upon our acceptance of your Order, confirmed by our order confirmation email.


Order Amendments

Unfortunately we are unable to add items or remove items from an order once it has been placed.

Prices, delivery charges and payment
Prices
The price of a product shall be stated on this Website at the time you place the order except in the case of an obvious error. We have made every reasonable effort to ensure that all prices on our Website are accurate but errors may occur. 
All prices include VAT.

Delivery

Prices do not include the standard delivery charge of £6.95. This will be added to the final total unless you qualify for free delivery on orders over £50* or a unique code offer.

*In order to qualify for free delivery the £50 threshold must be reached after any promotions or offers have been calculated.

Our delivery service is available in the UK mainland only. We are unable to deliver to Northern Ireland, Scottish Highlands and Channel Islands.

We endeavour to deliver orders within 3 to 5 working days subject to availability of the products*. Orders on a Friday, Saturday and Sunday will not be processed until Monday due to us only operating on weekdays Monday - Friday (excluding Bank holidays).

Delivery is complete when the products have been received by you (or another person identified by you) at your chosen address. You are only responsible for the product when it is delivered to you. 

* We will email or contact you via telephone if we are unable to despatch your product within 5 working days 

If for any reason you do not receive your delivery, please note that we will only consider claims for lost sent 30 days after the latest due date for UK orders.

Additionally we will not accept liability for lost orders, if you select for your parcel to be left in a safe place or with a neighbour

Payment
The available methods of payment are displayed on the Website at checkout. Payment will be debited from your account at the point you confirm your order.

Resale of a product

From this site we only sell products for domestic and private use by consumers. You may not sell or resell any of the products you receive from us. Please contact us here if you wish to discuss or transact on a business opportunity.

Description and Specification of Goods

We make reasonable efforts to ensure that the Goods conform to illustrations, photographs and descriptions provided via our website or by our customer Service team. We cannot, however, guarantee that all descriptions, illustrations and/or photographs will be precisely accurate due to discrepancies that may arise during the printing process and differences in the colour reproduction of electronic displays. 

Cancellation, Returns and Refunds

You have certain rights under the law, these include:

Cancellation

You have a right to cancel your order within 30 days beginning the day after the day on which you receive the product, and to receive a full refund, even if the product is not defective. See the returns policy below.

Returns

Faulty, damaged or incorrect goods

We are required by law to supply Goods that are of satisfactory quality.  Your rights if you receive any Goods that are not of satisfactory quality are set out in faulty item and returns policy click here 

Beginning on the day that you receive the products you have 30 Days in which to return the products and to receive a full refund of the price together with the cost of delivery if charged. 

You have no right to a refund or to replacement of the products if you have purchased them for an unsuitable purpose that is neither obvious nor made known to us and the problem has resulted from your use of the products for that purpose; or if the problem is the result of normal wear and tear, misuse or intentional or careless damage.  

Refunds within 14 Days of the day on which We agree that you are entitled to the refund.

Churchill Cancellation of Order
We may cancel your order at any time before we dispatch the products in the following circumstances:
  • The Goods are no longer in stock and we are unable to re-stock (if, for example, the Goods are discontinued); or
  • An event outside of our control continues for more than 90 days 
  • If we cancel your order and you have already paid for the products, the payment will be refunded to you within 14 Days. If we cancel your order, we will inform you by telephone and /or email. 
User comments, feedback and other submissions 

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

 We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

 You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.

You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.


Our Liability

We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these Terms and Conditions or as a result of Our negligence (including that of Our employees, agents or sub-contractors).  Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it is contemplated by you and Us when the Contract is created.  We will not be responsible for any loss or damage that is not foreseeable.

 We only supply Goods for domestic and private use by consumers.  We make no warranty or representation that the Goods are fit for commercial, business or industrial use of any kind (including resale).  We will not be liable to you for any loss of profit, loss of business, interruption to business or for any loss of business opportunity.

Nothing in these Terms and Conditions seeks to limit or exclude Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); or for fraud or fraudulent misrepresentation.

Nothing in these Terms and Conditions seeks to exclude or limit your legal rights as a consumer. 
Events Outside of Our Control

We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond Our reasonable control.  Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond Our reasonable control.

If any event occurs that is likely to adversely affect Our performance of any of Our obligations under these Terms and Conditions:
  • We will inform you as soon as is reasonably possible;
  • Our obligations will be suspended and any time limits that We are bound by will be extended accordingly;
  • We will inform you when the event outside of Our control is over and provide details of any new dates, times or availability of Goods as necessary;


If the event outside of our control continues for more than 30 days. We may cancel the order and inform you of the cancellation.  Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible;

If an event outside of our control occurs and you wish to cancel the Contract, you may do so.  Any refunds due to you as a result of such cancellation will be paid to you as soon as is reasonably possible.

The Contract is between you and us.  It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms and Conditions

If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms and Conditions.  The remainder of these Terms and Conditions shall be valid and enforceable.

No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.
